MINUTES OF THE PUBLIC MEETING OF FEBRUARY 13, 2007
TOWN HALL, 542 LIBERTY STREET, HANSON, MA


Called to Order at 7:00 PM under M.G.L. Chapter 131, s.40 and the Hanson By-Law 3-13, s.5. by Philip Lindquist, Chairman, in Meeting Room A on the top floor of the Town Hall.

7:00 PM  Notice of Intent for the construction of a single family home with associated utilities, driveway, filling and grading within the buffer zone of a Bordering Vegetated Wetland at Reed Street, Map 33, Lot 14-3 for Nicole and Christopher Ebert represented by Woodward Environmental Services, 95 Spring Meadow Lane, Hanover, MA  (DEP#SE175-0518)  (New Hearing) – continue per request of applicant to February 27th, 2007 at 8:00 PM

Appointments

7:15 PM  Appointment with Paul Mirabito of Ross Engineering to discuss drainage issues at the end of Bonney Hill Lane per a Certificate of Compliance Request (DEP #SE175-357)

Paul Mirabito attended the meeting with Mr. and Mrs. Bud Doolittle who were the original applicants/owners of the subdivision.  Ron Grattan arrived at 7:05 PM.  Mr. Mirabito displayed the lot layout plan as per the Orders of Conditions that was recorded on 8/28/01.  He proceeded to answer a few of the questions that Frank Schellenger raised during a site visit on 9/29/06.  In response to comment #3 of the site report, the hoods had been replaced in the catch basins.  As per comment #8, additional rip-rap had been added at the end of the detention basin.  Mr. Schellenger asked about over-flow detail of the pipe that was approved.  He disputed the




elevations as shown on the plan because the spillway of the basin was not working properly in the field.  Mr. Schellenger also questioned the functionality of the level spreader.  Mr. Mirabito contended that the detention basin was built essentially to the plan and the level spreader was observed during a heavy rainstorm in August and was functioning correctly.  In addition, Mr. Lindquist observed that water was overflowing a berm and pooling in the driveway of 92 Bonney Hill Lane.    In cold weather it was freezing up and causing a hazard.  He contended that the catch basin was not located at the low point of the slope.  Mr. Schellenger pointed out that the Operation and Maintenance Plan did not identify who’s responsible for the on-going maintenance of the drainage system(s).   Mr. Doolittle answered that an easement was granted for the drainage on Lot 3.  Ms. Nehiley was not able to locate it in the file.   In conclusion the Commission requested that the following four issues be addressed before a decision can be rendered:  That the functionality of the level spreader is corrected, the overflow from the detention basin is rectified, the catch basin is relocated to the low point and a copy of a deed for the easement to maintain the detention basin is produced.

Public Hearings

7:30 PM  Notice of Intent for the repair/upgrade of a septic system within the buffer zone of a Bordering Vegetated Wetland at 41 Pearl Street, Map 88, Lot 57 for Sarah Olsen represented by Hardy Engineering, 1287 Washington Street, Weymouth, MA  (DEP #SE175-0517)  (New Hearing)

Frank Schellenger read the Public Hearing Notice and the abutters were verified.  Shawn Hardy made the presentation.  The proposal consists of replacement of the existing tank with a Title 5, 1,500 gallon tank with a pump chamber.  A five-foot mound with a retaining wall and an impervious barrier are also required.  The system has been Board of Health approved.  Ms. Delaney, the former agent, had prepared draft conditions for the Commission to review based on her site inspection at which time she had observed filling and disturbance of wetlands.  The Commission requested that in addition to the Conservation Posts denoting a 5-foot buffer recommended as mitigation, that a 5-foot permanent buffer is maintained all around the tow of the slope and the vegetation allowed to grow in.

7:45 PM   Continued Notice of Intent (After-the Fact) for the construction of a connecting addition between the house and adjoining garage at 31 Ocean Ave., Map 2, Lot 946 for Deborah and Fred Burlone, Jr.  (DEP #175-0515)   

Mr. Burlone attended the hearing to explain to the Commission that he had mailed a plan to Natural Heritage approximately a month ago and was awaiting their decision.  The project is
within a Priority Habitat according to the new 12th Edition Natural Heritage Atlas (eff. Oct. 06). Ms. Nehiley will put a call into Division of Fisheries and Wildlife and find out what the status is.

8:00 PM   Continued Notice of Intent for the Taunton Watershed Pilot Wetlands Mitigation Bank which proposes to create 9.3 acres of new wetlands and enhance 16.2 acres of bog to forested wetlands at the Burrage Pond Wildlife Management Area in Hanson by BlueWave Capital, LLC, 137 Newbury Street, fl 7, Boston, MA  02116 represented by Beals & Thomas, Inc., 144 Turnpike Rd., Southborough, MA  (DEP #SE175-0516) – continued until March 13th at 8:00 PM per request of applicant

Budget
Ms. Nehiley will find out what the acronyms stand for on the report and inquire why the final figure doesn’t seem to add up.

Ms. Delaney made a call and spoke with Mr. Dumont, Jr..  He explained that his father had removed three truckloads of woodchips in November.  The work should be done sooner than they originally had thought.  They were frustrated to see that the Aghajanians had filled to within 20 feet of the wetlands.

Draft RFP for Open Space Plan
The RFP’s were distributed for comment.  None were received as of yet.

Blanket Determination for 724 Monponsett Street – reviewed

Letter from Land Planning requesting that a fine be rescinded for 69 Arlene Street
Mr. Crowell had written a letter explaining that the reason for not filing was because the wetland was located in Pembroke, not Hanson.  Mr. Schellenger argued that the wetland line is state mandated and is not a town issue.

Meeting with EOEA
The Executive Office of Environmental Affairs along with applicant Bluewave Strategies, LLC have requested a meeting with the Commission to discuss two issues:  Consultant fees and By-law fees.  Mr. Lindquist suggested a meeting next week on Tuesday, February 20th at 3:00 PM.  Ms. Nehiley was instructed to confirm the date and time with EOEA and post the meeting.

Memo to Commission from Interim Agent, Janine Delaney regarding Pilot Wetlands Bank - reviewed

Letter from Plymouth County Mosquito Control
Ms. Nehiley was instructed to send the letter dated 2/13/07 to Bluewave Strategies, LLC and Mass Audubon and include a cover letter requesting comment.
